California Attorney General Publishes Third Modification to CCPA Rules

The California Attorney General recently published a third set of modifications to the regulations under the California Consumer Privacy Act which became effective earlier this year.  The AG’s regulations originally became effective July 1, 2020, the first date of allowed enforcement under the statute.  The most recently published rules modify the regulations that became final August 14, 2020. 

The recent modifications include:

California Regulator Name Change to Department of Financial Protection and Innovation

Earlier this year, the California legislature enacted the Consumer Financial Protection Law (“CFPL”), under Assembly Bill 1864.  The law expands the powers of the Department of Business Oversight and includes a name change for the regulator to the Department of Financial Protection and Innovation. CFPB Issues Final Rule Extending the ATR/QM GSE Patch

On October 20, 2020, the CFPB issued a final rule that extends the sunset date of the temporary “GSE Patch” under the Ability-to-Repay/Qualified Mortgage (“ATR/QM rule”).  The extension was necessary to bridge the gap between the previously anticipated expiration date on January 10, 2021 and the effective date of a new general QM definition that was proposed earlier this year.  See information on that proposal
